Ask most people what a PR agency does, and they’ll talk about headlines, campaigns, and clever copy. What they won’t mention – because it’s largely invisible when done well – is the sprawling web of rules, regulations, and platform policies that sit behind every piece of public-facing content. Alcohol labelling laws. Platform advertising standards. Food and health claims. Influencer disclosure requirements. For agencies working across sectors, this compliance layer isn’t a footnote to the creative work. It is the work, just as much as the headline or the hook. When crafting a story for a client, the last thing anyone needs is to get into hot water over ads that might run adjacent to your campaign.

 

Why this matters for consumer brands

A few things have converged to make regulatory navigation a core PR skill rather than a legal afterthought.

Firstly, platforms have become regulators in their own right. Meta, TikTok, YouTube and X each maintain their own advertising policies that sit on top of – and sometimes diverge from – national law. A campaign that’s legal under the Advertising Standards Authority’s CAP Code can still get flagged or removed for breaching a platform’s community guidelines. Agencies now have to satisfy two rulebooks at once, and they don’t always agree.

Second, categories like alcohol and food carry sector-specific restrictions that go well beyond general advertising standards, and both have shifted significantly this year.

On food, the UK’s new restrictions on advertising “less healthy food” (LHF) became legally enforceable in early 2026, after the government moved to ban the promotion of identifiable less healthy food products online, including through paid social and influencer marketing. The rules apply to paid online advertising for products across 13 regulated categories that score as less healthy under the nutrient profiling model, covering paid social, boosted posts, display ads, and promoted listings on delivery platforms. Crucially, the restriction applies around the clock –  unlike the TV rules, which restrict less healthy food ads to slots after 9pm. One detail that regularly catches brands out: the ASA has confirmed that even a single identifiable less healthy product featured in an ad is enough to constitute a breach, so a lifestyle post that happens to show the wrong product in the background can be as risky as a dedicated ad. There is some breathing room – the rules do allow “brand-only” advertising, where a company promotes its corporate brand or a general range without identifying a specific less healthy product – but drawing that line correctly in creative requires specialist input, not guesswork.

What good practice actually looks like

For us, navigating this landscape isn’t about killing creativity with caution – it’s about building compliance into the process early enough that it never becomes a bottleneck. We’re self-confessed overthinkers. A few principles guide how we work:

  • Know the industry, and know it’s moving. Alcohol, food, gambling (though that’s not really our buzz), finance, health and beauty each have their own regulatory bodies and codes, and those codes are being actively rewritten. The LHF ad ban and the tightened labelling expectations for alcohol alternatives are two live examples of rules that changed materially within the last twelve months. There’s no substitute for knowing the current state of a client’s sector before a single word of copy is written, rather than checking after the fact.

 

  • Treat platform policies as a separate rulebook. When relevant, Clearbox maps out platform-specific requirements alongside statutory ones at the brief stage. A claim that’s fine under advertising law might still need an age-restriction, a paid-partnership label, or different phrasing to survive a platform’s automated review. 

 

  • Build disclosure in from the start. Paid partnership disclosure requirements have tightened considerably recently. Identifying the perfect collaborator for a campaign can be all for nothing without clear, compliant disclosure.

 

  • Keep a paper trail. Evidence for any claim – nutritional, health-related, or performance-based – needs to exist before the content goes live, not be assembled defensively afterwards. We keep documentation ready in case a regulator asks. Data-backed, always.

 

  • Stay current, not just compliant. Rules change. Platform guidelines are updated more often than most people realise, and regulatory bodies periodically revise codes and issue new guidance. Part of the job is simply staying subscribed, informed, and ready to adapt a live campaign if the ground shifts underneath it.

 

The upside of getting it right

There’s a temptation to see regulation purely as a constraint on creativity. In practice, the opposite is often true. Clients who trust that their agency understands the rules give that agency more room to be bold, because the guardrails are already built in. Campaigns compliant from the outset don’t need watering down at the eleventh hour by a legal team. And brands that consistently get this right build a reputation – with regulators, platforms, and audiences alike – that outlasts any single campaign.

The best compliance work is the kind nobody notices. No takedowns or awkward corrections. Just a campaign that lands exactly as intended, because someone did the unglamorous work of checking the rules first. The devil’s in the detail, and finessing our phrasing without losing the heart of our messaging  is always a priority. Never boring, (but always compliant.)
